Terms of Use

The rules of the road for using ControlHF. We've kept them fair, clear, and human-readable.

Section 01

Acceptance of Terms

By accessing or using any ControlHF product — including the mobile application, the web application at app.controlhf.com, and the clinician portal at care.controlhf.com (collectively, the "Services") — you agree to be bound by these Terms of Use and all policies incorporated herein by reference, including our Privacy Policy and HIPAA Notice of Privacy Practices.

If you do not agree to these Terms, you must not access or use the Services. Your continued use of the Services following any update to these Terms constitutes acceptance of the revised Terms.

Age requirement

You must be at least 18 years of age to create an account and use the Services independently. Users between the ages of 13 and 17 may use ControlHF only under the supervision and with the consent of a parent or legal guardian, who must create and manage the account on the minor's behalf.

Important: ControlHF is a remote patient monitoring tool and is not a substitute for professional medical care. Always consult your physician or a qualified healthcare provider for any medical decisions, diagnoses, or treatment plans.


Section 02

Description of Services

ControlHF operates a remote patient monitoring (RPM) platform designed specifically for individuals living with heart failure and the clinical teams who care for them. Our Services include:

  • Mobile application: Available on iOS and Android, the ControlHF app allows patients to log daily symptoms, sync biometric readings from connected devices, receive personalized alerts, and communicate with their care team.
  • Web application (app.controlhf.com): A browser-based portal providing the full feature set of the mobile app, accessible from any device.
  • Care portal (care.controlhf.com): A clinical dashboard where authorized physicians, nurses, and care managers can view patient monitoring data, configure alert thresholds, and document clinical interventions for RPM billing.

ControlHF provides clinical decision support tools. All clinical decisions, including medication changes, care escalations, and diagnoses, are made exclusively by licensed healthcare professionals.

ControlHF is NOT an emergency service. If you are experiencing a medical emergency, call 911 immediately. Do not use the ControlHF app or portal to report a medical emergency.

ControlHF does not provide ambulance dispatch, emergency medical services, or real-time clinical intervention. Our alert system is designed to notify your care team during normal clinical operations and does not guarantee immediate clinical response.


Section 03

User Accounts

To access most features of the Services, you must create a ControlHF account. By creating an account, you agree to the following:

Account creation

  • Accurate information: You must provide truthful, accurate, current, and complete information during registration and keep your account information updated at all times. Providing false health data may result in inaccurate monitoring and could pose a risk to your health.
  • One account per person: Each individual may maintain only one active patient account. Clinicians may have a separate care portal account in addition to a patient account.
  • Age verification: You affirm that you are 18 years of age or older, or that a parent or guardian is creating and supervising the account on behalf of a minor with appropriate consent.

Password & security

  • Password security: You are responsible for maintaining the confidentiality of your password. Choose a strong, unique password and do not reuse passwords from other services.
  • No sharing: You may not share your login credentials with any other person. Each authorized care team member must have their own account provisioned through the care portal.
  • Breach notification: You must notify us immediately at security@controlhf.com if you suspect unauthorized access to your account.

Account suspension & termination

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, engage in abusive behavior, or pose a security risk. In cases where suspension is for a suspected violation rather than confirmed misconduct, we will notify you and provide an opportunity to respond before permanent termination.


Section 04

Medical Disclaimer

ControlHF is a clinical decision support tool. The information, alerts, trend analyses, and risk scores provided through the Services are intended to assist your care team — they are not a diagnosis, a treatment recommendation, or a substitute for professional medical judgment.

  • Clinical decision support only: All outputs from ControlHF — including alert notifications, risk stratification scores, and trend summaries — are informational aids. They do not replace the clinical judgment of your physician or care team.
  • Licensed physicians make all clinical decisions: Every care protocol action taken in response to ControlHF data is the responsibility of a licensed healthcare professional. ControlHF Inc. does not make clinical decisions.
  • No doctor-patient relationship: Use of the ControlHF platform does not create a doctor-patient relationship between you and ControlHF, Inc. or any of its employees, officers, or contractors.
  • Consult your physician: You should discuss all changes to your symptoms, weight, or health status with your physician promptly, regardless of whether the app generated an alert. Do not delay seeking medical care based on the absence of an alert.

Never disregard professional medical advice or delay seeking it because of something you read or experienced in ControlHF. If you think you may have a medical emergency, call 911 or your local emergency number immediately.


Section 05

Acceptable Use

You agree to use the Services only for their intended lawful purposes. The following uses are expressly prohibited:

You may not

  • Reverse engineer the platform: Decompile, disassemble, reverse engineer, or attempt to derive the source code of any part of the Services, including the mobile applications and care portal.
  • Share your login credentials: Provide your username or password to any third party. Each user must have their own account. Sharing credentials undermines data security and your account's clinical integrity.
  • Submit false health data: Enter inaccurate, fabricated, or deliberately misleading health data, symptoms, or readings. Doing so may result in incorrect clinical alerts, inappropriate care decisions, and real risk to your health or the health of others.
  • Harass or harm others: Use the Services to send threatening, abusive, or harassing messages to other users, care team members, or ControlHF staff.
  • Circumvent security controls: Attempt to bypass, disable, or interfere with any security features, access controls, or rate limits of the platform.
  • Scrape or extract data: Use automated tools to extract, scrape, or copy data from the Services, including patient data, clinical protocols, or platform infrastructure details.
  • Violate applicable law: Use the Services in violation of any applicable local, state, national, or international law or regulation, including HIPAA and other health privacy laws.

ControlHF reserves the right to investigate suspected violations and may report confirmed violations to appropriate authorities where required by law.


Section 06

Intellectual Property

The ControlHF platform, including but not limited to its software, algorithms, user interface designs, alert logic, clinical protocols, brand marks, and all content created by ControlHF, is the exclusive intellectual property of ControlHF, Inc. and is protected by U.S. and international copyright, trademark, patent, and trade secret laws.

What ControlHF owns

  • Platform software: All source code, compiled applications, APIs, and related software components.
  • Algorithms and models: All clinical decision support models, risk scoring algorithms, and alert threshold logic developed by ControlHF.
  • Brand assets: The ControlHF name, logo, tagline, and all associated brand materials.
  • Aggregate insights: De-identified, aggregated population health insights derived from platform data, which ControlHF may use for research and product improvement purposes.

What you own

You retain full ownership of your personal health data entered into or generated through the Services. ControlHF does not claim ownership over your biometric readings, symptom logs, or health records. You grant ControlHF a limited, non-exclusive license to use your health data solely for the purpose of providing and improving the Services as described in our Privacy Policy.

Your health data is yours. We are stewards of your data, not owners. You may export or delete your data at any time through Settings → Privacy & Data.


Section 07

Subscription & Billing

ControlHF offers both a free tier and paid plans. By subscribing to a paid plan, you authorize ControlHF to charge your payment method on a recurring basis.

Billing cycle

Consumer subscriptions are billed monthly on the anniversary of your subscription start date. Enterprise contracts are billed per the terms of the executed order form. All prices are in U.S. dollars and exclude applicable taxes.

Refund policy

Consumer subscriptions may be cancelled at any time. Upon cancellation, you will retain access to paid features until the end of the current billing period. Refunds are issued on a pro-rated basis for the unused portion of the current billing period when cancellation is requested within 7 days of a charge. After 7 days, no refund is issued for the current period, but no future charges will occur.

For billing disputes or to request a refund, contact billing@controlhf.com within 30 days of the charge in question.


Section 08

Termination

Either you or ControlHF may terminate your account and your use of the Services at any time.

Termination by you

You may close your account at any time through Settings → Danger Zone → Delete Account. Upon initiating account deletion, your account is deactivated immediately and queued for permanent deletion.

Termination by ControlHF

We reserve the right to suspend or terminate your access to the Services, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or abusive behavior, or if we are required to do so by law.

What happens to your data

  • 90-day retrieval window: Following account termination, your data remains retrievable for 90 days. During this period, you may contact us to export a copy of your health data in JSON or PDF format.
  • Permanent deletion: After the 90-day window, your personal data is permanently deleted from our active systems. Certain records may be retained in encrypted archives for up to 7 years to comply with clinical documentation and legal requirements, after which they are permanently purged.
  • De-identified data: Aggregate, de-identified data derived from your usage may be retained indefinitely for research and platform improvement purposes, as this data cannot be used to identify you.

Section 09

Limitation of Liability

To the maximum extent permitted by applicable law, ControlHF, Inc. and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.

Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ControlHF does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Cap on damages

In no event shall ControlHF's total cumulative liability to you for all claims arising out of or related to these Terms or the Services exceed the total fees paid by you to ControlHF in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any fees, ControlHF's total liability shall not exceed one hundred dollars ($100 USD).

Indemnification

You agree to indemnify, defend, and hold harmless ControlHF, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or health data right; or (d) any claim that your submitted content caused damage to a third party.


Section 10

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Arbitration clause

Except for claims that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in San Francisco, California, or via videoconference at your election. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver

You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis. You expressly waive any right to bring or participate in any class action, collective action, or representative proceeding against ControlHF. The arbitrator may not consolidate more than one person's claims.

30-day notice before arbitration

Before initiating arbitration, you must provide ControlHF with at least thirty (30) days' written notice of your intent to arbitrate by emailing legal@controlhf.com with the subject line "Notice of Intent to Arbitrate." During this 30-day period, ControlHF will attempt to resolve the dispute informally. If the dispute cannot be resolved informally, either party may proceed to arbitration.
